The Supreme Court has rejected Tarun Tejpal's plea for exemption from surrendering, directing the former Tehelka editor to hand himself over to police within a fortnight to serve a 10-year sentence.
The Supreme Court of India on Tuesday ordered Tarun Tejpal, the 62-year-old former editor-in-chief of Tehelka magazine, to hand himself over to law enforcement authorities within two weeks to serve out a custodial sentence following his conviction in a high-profile sexual assault case.
Dismissing his plea for relief from surrendering, the apex court firmly rejected Tejpal’s contention that he was the target of political victimhood. The legal team representing the veteran journalist had argued before the bench that the charges against him were politically motivated and urged the court to grant him an exemption from surrendering to police custody. The court, however, found no merit in these assertions, clearing the path for the execution of his prison sentence.
The Origins of the 2013 Incident
The criminal proceedings trace back to November 2013, during an annual event hosted by the investigative magazine at a luxury hotel resort in Goa. According to the prosecution's case, Tejpal subjected a junior female colleague to sexual assault inside an elevator of the hotel premises while attending the conference.
The incident triggered widespread public outrage and initiated an extensive criminal investigation by the Goa Police. Tejpal was subsequently arrested and formally charged under multiple sections of the Indian Penal Code, including provisions relating to rape, sexual harassment, and illegal confinement.
A Long Legal Battle in the Lower Courts
The case against Tejpal has wound a protracted path through various tiers of the Indian judicial system over the past decade. Following a lengthy trial, the local trial court in Goa initially acquitted Tejpal of all charges, delivering a verdict that sparked intense legal debate and criticism from women's rights advocates.
Unsatisfied with the trial court's determination, the Goa state government promptly lodged an appeal before the Goa bench of the Bombay High Court, challenging the acquittal and seeking a review of the evidentiary record.
High Court Overturns Acquittal and Sentences Tejpal
Upon re-examining the trial record, witness testimonies, and physical evidence, the Bombay High Court set aside the trial court’s judgment. Overturning the acquittal, the High Court held Tejpal guilty of sexual assault and sentenced him to ten years of rigorous imprisonment.
